Terms of Service

By creating a SafeCheck account or using our Service at safecheck.sbs, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
SafeCheck provides software tools for documenting food safety compliance — digital checklists, temperature logs, receiving records, certification tracking, and related reports. The Service is provided on a subscription basis with a free plan and paid tiers.
2. Accounts
You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at hello@safecheck.sbs if you suspect unauthorized access.
3. Subscriptions and payment
- Paid plans renew automatically at the end of each billing period until cancelled.
- Payments are processed by Stripe. By entering payment information, you agree to Stripe’s terms.
- You can cancel at any time from your billing page. Cancellation takes effect at the end of the current period.
- We do not offer refunds for partial billing periods, except where required by law.
- Prices may change with 30 days’ notice. Active subscriptions are honoured at their existing rate until the next renewal.
4. Acceptable use
You agree not to:
- Upload unlawful, defamatory, or infringing content
- Attempt to gain unauthorized access to other accounts or our infrastructure
- Scrape, reverse-engineer, or resell the Service
- Use the Service to spam, harass, or violate any applicable law
- Submit false compliance records to deceive inspectors or regulators
We may suspend or terminate accounts that violate these rules.
5. Your data and content
You retain ownership of the data you enter into SafeCheck (checklists, logs, photos, records). You grant us a limited license to store, display, and process it solely to operate the Service for you. See our Privacy Policy for details.
6. Not legal or regulatory advice
SafeCheck is a software tool, not a substitute for professional food safety, legal, or regulatory advice. Our templates and guides are based on FDA Food Code and general best practices, but requirements vary by jurisdiction. You are solely responsible for:
- Knowing and complying with food safety laws in your area
- The accuracy of the data you record
- The actions you or your staff take based on information in the Service
- Passing health inspections and responding to regulators
Using SafeCheck does not guarantee that you will pass an inspection or avoid violations.
7. Availability
We aim for high uptime but do not guarantee uninterrupted service. Planned maintenance, bugs, and third-party outages (Supabase, Stripe, Vercel) can affect availability. The Service includes an offline mode so you can continue to record data when disconnected; it syncs when you reconnect.
8. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, SafeCheck’s total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, fines, or damages from failed inspections.
10. Indemnification
You agree to indemnify SafeCheck against claims arising from your use of the Service in violation of these Terms or any law.
11. Termination
You can terminate at any time by cancelling your subscription and deleting your account. We may terminate or suspend accounts for material breach, extended non-payment, or if we discontinue the Service (we will give reasonable notice and allow data export).
12. Changes
We may update these Terms. Material changes will be announced by email or in-app notice. Continued use after changes means you accept the new Terms.
13. Governing law
These Terms are governed by the laws applicable where the operator of SafeCheck is located. Disputes should first be raised via email at hello@safecheck.sbs so we can try to resolve them informally.
